BOND RESOLUTION OF THE TOWN OF NEWSTEAD, NEW YORK, ADOPTED FEBRUARY 25, 2018 AND AMENDED JUNE 14, 2021, APPROPRIATING $1,500,000 FOR THE INCREASE AND IMPROVEMENT OF FACILITIES OF THE TOWN OF NEWSTEAD CONSOLIDATED WATER DISTRICT NO. 1, AUTHORIZING THE ISSUANCE OF BONDS IN THE PRINCIPAL AMOUNT OF $1,500,000 TO FINANCE SAID APPROPRIATION AND AUTHORIZING THE EXPENDITURE OF ANY GRANT FUNDS TO BE RECEIVED FOR SAID PURPOSE

The resolution, a summary of which is published herewith, has been adopted on the 14th day of June, 2021, and the validity of the obligations authorized by such resolution may be hereafter contested only if such obligations were authorized for an object or purpose for which the Town of Newstead, in the County of Erie, New York is not authorized to expend money or if the provisions of law which should have been complied with as of the date of publication of this notice were not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the publication of this notice, or such obligations were authorized in violation of the provisions of the constitution.

The object or purpose for which the bonds are authorized is the increase and improvement of facilities of the Town of Newstead Consolidated Water District No. 1, at the estimated total cost of $1,500,000, consisting of the installation of 3,600 lineal feet of 8-inch diameter PVC waterline and appurtenances along Knapp Road, 4,350 lineal feet of 8-inch diameter PVC waterline and appurtenances along Indian Falls Road and 1,150 lineal feet of 8-inch PVC waterline and appurtenances along Kirby Road, connection to the existing waterline, including acquisition of land or rights in land, if any, installation of new fire hydrants, equipment, furnishings, machinery or apparatus, and any ancillary or related work required in connection therewith.

The maximum amount of obligations authorized to be issued is $1,500,000.  It is expected that grant funds will be received from the NYS Environmental Facilities Corporation WHA Grant program and/or other sources.

The period of probable usefulness is forty (40) years.

A complete copy of the Bond Resolution summarized above shall be available for public inspection during normal business hours at the office of the Town Clerk, Town Hall, 5 Clarence Center Road, Akron, New York.
