The foregoing Supplemental Summons is served upon you by publication, pursuant to an order of HON. Diane Devlin of the Supreme Court Of The State Of New York, dated the Sixteenth day of August, 2024 and filed with the Complaint in the Office of the Clerk of the County of Genesee, in the City of Batavia. The object of this action is to foreclosure a mortgage upon the premises described below, dated April 21, 2004, executed by James P. Ward (who died on August 30, 2019, a resident of the county of Genesee, State of New York) to secure the sum of $44,000.00. The Mortgage was recorded at Instrument Number 3137 Book 1423, Page 123 in the Office of the Genesee County Clerk on April 26, 2004. The mortgage was subsequently assigned by an assignment executed August 16, 2011 and recorded on August 24, 2011, in the Office of the Genesee County Clerk at Instrument Number 4091Book 322, Page 82. The mortgage was subsequently assigned by an assignment executed August 20, 2021 and recorded on September 2, 2021, in the Office of the Genesee County Clerk at Instrument Number MTG2021-1614.
