Newstead Town Board approves egg processing facility site-plan

Newstead Town Board members determined a proposed egg processing facility on North Millgrove Road will not have a significant effect on the environment and issue a State Environmental Quality Review Act (SEQRA) Negative Declaration at their Board meeting Monday night.

Board members also voted to approve the site plan submitted by Kreher Brother LLC for construction of the +/- 92,000 sq ft egg processing facility to be located at 5005 N Millgrove Road, disturbing approximately 12 acres of +/-122 acre parcel in the RA Zoning district in the Town of Newstead.

Board members discussed the comments made during a March 9 public hearing on the proposed site plan, written comments, and the site-plan, as well as the Planning Bord recommendation to approve and responses from the NYS Department of Environmental Conservation (DEC), New York State Department of Transportation (NYSDOT), and Erie County Water Authority (ECWA) prior to making their decision.

Residents from Havens Rd., Havenwood Dr., and Stage Road had lifted concerns over hours of operation, noise, lighting, traffic, safety, and property values during the nearly hour-long public hearing on March 9.

Krehers’ submitted the request because they need their egg processing plant separate from their chickens to minimize possible contamination related to the Avian flu.

Zoning for the North Millgrove location is appropriate under a ruling from Ag and Markets that the processing facility is a function of the farm operation.  No chickens will be on the site.  During the Public Hearing, Newstead Code Enforcement Officer Dave Miller said that the facility will have three systems to handle waste and storm water on the site.  He also shared that the parking lot is more than 600 feet away from any neighbor and all lighting will be directed downward or toward the building for security, and discussions are underway regarding berms or other ways of obscuring the building.

Reassessment nears completion

In the March Assessor’s Report to the Town Board, Assessor Tina M. Rados, SCA reported that she is wrapping up the reassessment of town properties and plans to start mailing the change of assessment notices around the first week of April.

“To accommodate as many property owners as possible, in lieu of informal meetings, I am sending a form with the change notices to make it easier for individuals to have the opportunity for the informal assessment review,” Rados told the Board.  In addition to the form, she will send an informational letter and have a comparable sales list and other educational information on the assessment website page.

“My office is happy to assist property owners through the process whenever questions arise.” She noted.

Public Hearing

Board members set a Public Hearing on a site plan application for nutritional drink shop called Fire and Ice Nutrition at 13025 Main Road in the C-2 zoning district, for April 13 at 7:25 p.m.

Action items

Board members approved a motion authorizing Court Clerk Consiglio to attend annual training in September and a motion to increase driveway permit fees.

Building permits

A Building permit report from February 24, 2026 to March 20, 2026 includes a pole barn garage at 11063 Clarence Ctr. Rd., a pole barn at 12148 Nice Rd., a shed at 12251 McNeeley Rd., a pavilion at 5720 Cummings Rd., roof/siding/windows at 12420 Clarence Ct Rd., a roof at 13558 Bloomingdale Rd., a kitchen renovation at 12831 Dorsch Rd., and an addition to a barn at 12287 Clarence Ctr Rd.
